The ongoing larceny trial involving Ismael Sesay, 22, and Mohamed Lamin Sesay continued on Monday, 3 August 2026, before Magistrate John Manso Fornah at the Pademba Road Court No. 2 in Freetown, where the court ordered a subpoena for an absent prosecution witness.
The two accused persons are facing two counts of larceny contrary to Section 2 of the Larceny Act, 1916.
According to the police charge sheet, Mohamed Lamin Sesay was alleged to have, on Tuesday, 7 July 2026, at Leicester Peak, Freetown, stolen a quantity of electric cable valued at NLe 1,500, belonging to Mamadu Yero Jalloh.
The second count alleges that Ismael Sesay, on the same date and location, stole a quantity of electric cable valued at NLe 1,500, also belonging to Mamadu Yero Jalloh.
When the charges were read and explained to both accused persons, they pleaded not guilty.
Prosecutor Sergeant 3379 Ballay T informed the court that the first prosecution witness was absent and applied for an adjournment.
Defence Counsel L. Ellis applied for the accused persons to be discharged under Section 95, citing the repeated absence of the prosecution witness on three previous adjourned dates. Alternatively, he relied on his earlier bail application and requested that the accused be granted bail.
In his ruling, Magistrate Fornah noted that there was no affidavit in opposition to the bail application and granted bail to both accused persons.
The two defendants were granted bail in the sum of NLe 3,000 each, with one surety each in like sum. The sureties must reside in Freetown and produce valid National Identification Cards. The bail conditions are to be approved by the court.
The Magistrate, however, ordered that a subpoena be issued and served on the absent prosecution witness.
The matter has been adjourned to 10 August 2026 at the instance of the prosecution.
